Limited Warranty

Outer is committed to producing products that are of high quality and durable. For a list of the Outer Products covered by this Limited Warranty (Covered Products) and the Warranty Period applicable to them, please refer to the table in the “What are the Covered Products and the applicable Warranty Periods?” Section, below.

Subject to the conditions and restrictions described in this Limited Warranty, we warrant, to the original purchaser of a Covered Product, that the Covered Product shall be free of defects in both construction materials and workmanship for the applicable Warranty Period.

This Limited Warranty covers Covered Products purchased in Australia only. If you purchased an Outer Product outside Australia, your product may be subject to a separate warranty that is applicable in the country you purchased it.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS.

Who is Covered?

This Limited Warranty extends only to the customer who (a) originally purchased the Covered Product directly from Outer, (b) is located in Australia, and (b) is using the Covered Product for non-commercial in-home use only. It does not extend to any subsequent owner.

What are the Covered Products and applicable Warranty Periods?

Covered Products are any Outer products described in the table below that have been manufactured and sold to you by Outer in Australia, are owned by the original purchaser, are used in residential non-commercial settings only.

During the applicable Warranty Period, this Limited Warranty provides remedies for any Covered Product found to have defects in materials or workmanship (defects introduced during the manufacturing of the Covered Product or any of its component parts that cause the Covered Product to be unsound structurally or mechanically, or substantially altered in appearance) when used under normal conditions in a residential setting (“Defective Products”).

COVERED PRODUCT

Teak Sofas and Chairs

WARRANTY PERIOD

Subject to the exclusions described herein, the Limited Warranty for Teak Sofas and Chairs covers broken frames, loose joints, cracking and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

Note, however, teak will form cracks during this natural weathering process. Only cracks that are deemed to affect the structural integrity of the item for normal use will be covered by this Limited Warranty.

Teak will weather to a silvery grey patina over time, if left untreated. This natural mellowing will not affect the quality or performance of your piece, and is not considered a quality defect.

While teak is extremely resistant to damage from extreme weather, it should not be placed directly on organic material for extended periods. Anytime wood is in direct contact with dirt or grass it becomes susceptible to exposure to mould, bacteria, and fungus. Regular cleaning, at least 2-3 times per year, will help maintain the wood’s integrity and remove dirt, and any other environmental buildup.

  • Minor cosmetic cracks
  • Minor variations in colour or texture of finishes
  • Some natural teak oil may transfer to cushions or OuterShell® covers during every day usage. This is a normal behavior for teak; oil transfer to cushions and OuterShell® will not be covered by Outer's warranty

  • Minor cosmetic cracks
  • Minor variations in colour or texture of finishes

Wicker Sofas and Chairs: Metal Components (Frame and Legs)

Subject to the exclusions described herein, the Limited Warranty for Wicker Sofa and Chairs (Metal Components) covers broken frames, loose joints and welds, splintering and cracking of material, and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or substantially alter the appearance of the item.

NOT COVERED:

  • Minor cosmetic cracks
  • Minor variations in colour or texture of finishes
  • Flaking, chipping, bubbling, or other cosmetic defects to the paint on the frame that cannot be seen when the sofa is placed in its normal orientation

Wicker Sofas and Chairs: Wicker Components

WARRANTY PERIOD

Subject to the exclusions described herein, the Limited Warranty for Wicker Sofa and Chairs (Wicker Components) covers broken or displaced wicker strands or excessive fading that, in each case, substantially impairs the appearance of the item.

  • Minor cosmetic cracks
  • Minor variations in colour or texture of finishes

COVERED PRODUCT

Cushions purchased with the Outer Sofas and Chairs

WARRANTY PERIOD

5 years from date of purchase

PRODUCT-SPECIFIC EXCLUSIONS, CONDITIONS, AND DETAILS (See also What is NOT Covered under this Limited Warranty?)

Subject to the exclusions described herein, the Limited Warranty for Cushions covers seam slippage, buttons, and zipper closures and excessive fading, colour change or strength loss and other defects in workmanship and materials that substantially alter the appearance or structural integrity of the item.

Note: Cushion cores used in seat cushions, back pillows, and padding will soften and conform to the shape of the user as a result of normal use. This is not considered a manufacturing defect. Outer will only warrant sofa and chair cushions against abnormal loss of foam resiliency if it determines that such loss is not caused by normal use.

NOT COVERED:

  • Tears, shrinkage or pilling of cushions or other fabric
  • Normal flattening or compression of cushions
  • Minor variations in colour or texture of fabric

Subject to the exclusions described herein, the Limited Warranty for Teak & Aluminum Dining Tables covers broken frames, loose joints and welds, and excessive fading, cracking and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece, including, with respect to aluminum components, any excessive peeling or blistering of the finish.

  • Tears, shrinkage or stretching of fabric
  • Minor variations in color or texture of fabric

Other Outer Products

COVERED PRODUCT

Outer Products other than Outer Sofas, Chairs, Dining Tables, and Fire Pit Tables

Subject to the exclusions described herein, the Limited Warranty for Other Outer Products covers defects in workmanship and materials that cause the piece to be unsound structurally, or substantially alter its appearance, or cause it to become unserviceable.

NOT COVERED:

  • Tears, shrinkage, stretching or pilling of fabric
  • Colour changes due to normal exposure to sun and atmospheric chemicals
  • Minor variations in colour or texture of materials such as fabric or rugs
  • Staining

What must I do to protect my Outer Products?

Outer has taken great care in designing and building its products to stand up to harsh environments, but nothing is foolproof. Care and maintenance are required to ensure the proper lifetime of your furniture and other products. While mildew and mould grow on dirt, pollen and other organic matter, simple routine cleanings can prevent them from forming on fabrics. Cover the products when not in use and store them in a dry place during times of extended non-use. Before covering, products need to be thoroughly cleaned and dried to prevent mildew during storage. Cushions should be removed and stored in a dry place if possible. Extra care is required if the products are used by an indoor pool or near the seaside. What is NOT Covered under this Limited Warranty?

This Limited Warranty does not cover any damage due to:

  • Transportation other than through the initial delivery by Outer
  • Improper Storage
  • Improper or negligent use, handling, assembly, or care of Covered Product, including, without limitation, the use of improper cleaning products, sun-tan oils or other chemicals
  • Failure to follow the Covered Product instructions or to perform any preventive maintenance
  • Modifications
  • Unauthorized repair
  • Normal wear and tear, corrosion, rust or stains, scratches, or dents, including the rusting or tarnishing of metal materials resulting from abrasive scratches
  • Non-residential uses
  • Excessive weight placed on the Covered Product, including damage to the frame or legs of Covered Products
  • Mould or mildew
  • Bursting or cracking of tubing due to exposure to water and freezing temperatures
  • Accident, abuse, neglect, theft, vandalism, pets, rodents, fire, flood, wind, hail, lightning, freezing temperatures, extreme temperatures, natural disasters or acts of God of any kind, or other external causes beyond Outer’s reasonable control
  • Some natural teak oil may transfer to fabric, cushions or OuterShell® covers during everyday usage. This is a normal behavior for teak; oil transfer to cushions and OuterShell® will not be covered by Outer's warranty

What are my Remedies under this Limited Warranty?

Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

If we receive a valid claim for a Defective Product within the applicable Warranty Period, we will either (a) repair the Defective Product at no charge, using new or refurbished replacement parts, or (b) exchange the Defective Product with a new or refurbished Product. If we determine it is not reasonable to repair or replace the Defective Product, we may choose to refund to you the purchase price paid for the Defective Product, rather than repair or exchange it.

Any replacement product will be warranted for the remainder of the original Warranty Period or thirty (30) calendar days, whichever is longer.

How do I obtain Warranty Service?

To obtain a repair, replacement or refund for a Defective Product under this Limited Warranty (“Warranty Service”), you must call +1 (855) 277-7744 or email our Customer Service Department at auorders@liveouter.com during the applicable Warranty Period. You will need to provide photos and a description of the defect.

Disclaimers; Implied Warranties

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. OUTER DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, OUTER LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY AND, AT OUTER’S OPTION, THE REFUND AND REPLACEMENT REMEDIES DESCRIBED ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Limitation of Liability

**EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, OUTER SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF OUTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY NOR, UNDER ANY CIRCUMSTANCES, SHALL OUTER’S LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. **

Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
