Limited Warranty

Outer is committed to producing products that are of high quality and durable. For a list of the Outer Products covered by this Limited Warranty (Covered Products) and the Warranty Period applicable to them, please refer to the What are the Covered Products and applicable Warranty Periods? section, below.

Subject to the conditions and restrictions described in this Limited Warranty, we warrant, to the original purchaser of a Covered Product, that the Covered Product shall be free of defects in both construction materials and workmanship for the applicable Warranty Period.

This Limited Warranty covers Covered Products purchased in the United States only. If you purchased an Outer Product outside the United States, your product may be subject to a separate warranty that is applicable in the country you purchased it.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

Who is Covered?

This Limited Warranty extends only to the customer who (a) originally purchased the Covered Product directly from Outer, (b) is located in the United States, and (c) is using the Covered Product for non-commercial in-home use only. It does not extend to any subsequent owner.

What are the Covered Products and applicable Warranty Periods?

Covered Products are any Outer products described below that have been manufactured and sold to you by Outer in the United States, are owned by the original purchaser, are used in residential non-commercial settings only.

During the applicable Warranty Period, this Limited Warranty provides remedies for any Covered Product found to have defects in materials or workmanship (defects introduced during the manufacturing of the Covered Product or any of its component parts that cause the Covered Product to be unsound structurally or mechanically, or substantially altered in appearance) when used under normal conditions in a residential setting (“Defective Products”).

Teak Sofas and Chairs

Subject to the exclusions described herein, the Limited Warranty for Teak Sofas and Chairs covers broken frames, loose joints, cracking and splintering of material and other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or that substantially alter the appearance of the piece.

Note, however, teak will form cracks during this natural weathering process. Only cracks that are deemed to affect the structural integrity of the item for normal use will be covered by this Limited Warranty.

Teak will weather to a silvery gray patina over time, if left untreated. This natural mellowing will not affect the quality or performance of your piece, and is not considered a quality defect.

While teak is extremely resistant to damage from extreme weather, it should not be placed directly on organic material for extended periods. Any time wood is in direct contact with dirt or grass it becomes susceptible to exposure to mold, bacteria, and fungus. Regular cleaning, at least 2-3 times per year, will help maintain the wood’s integrity and remove dirt, and any other environmental buildup.

• Minor cosmetic cracks
• Minor variations in color or texture of finishes
• Some natural teak oil may transfer to cushions or OuterShell® covers during every day usage. This is a normal behavior for teak; oil transfer to cushions and OuterShell® will not be covered by Outer's warranty

Subject to the exclusions described herein, the Limited Warranty for Cushions covers seam slippage, buttons, and zipper closures and excessive fading, color change or strength loss and other defects in workmanship and materials that substantially alter the appearance or structural integrity of the item.

Note: Cushion cores used in seat cushions, back pillows, and padding will soften and conform to the shape of the user as a result of normal use. This is not considered a manufacturing defect. Outer will only warrant sofa and chair cushions against abnormal loss of foam resiliency if it determines that such loss is not caused by normal use.

NOT COVERED:

• Tears, shrinkage or pilling of cushions or other fabric
• Normal flattening or compression of cushions
• Minor variations in color or texture of fabric
• Cushions used with non-Outer seating products

Veranda Sofas, Chairs, and Ottomans

WARRANTY PERIOD
Veranda frame and springs: Lifetime Limited Warranty
A Lifetime Limited Warranty is given by Outer to the original retail purchaser only. This covers the frame and spring system materials against failure or breakage under conditions of ordinary residential use. Lifetime is defined by the life of the original upholstery covering. Re-covering the frame voids all warranties. This lifetime limited warranty does not apply to any product intentionally misused; or damage resulting from negligence, exposure, rental or commercial use, or other unreasonable uses. Also the lifetime limited warranty does not cover damage or failures due to the application of any chemical treatment, improper cleaning, or when heavy soiling or abuse is evident.

Veranda foam:  2-Year Limited Warranty
Outer warrants to the original retail purchaser only, protection against failure of the fiber, cushion, and abnormal loss of resiliency of filling materials. These items are guaranteed to be free from manufacturing defects for a period of TWO (2) years. Compressing of polyurethane foam or fiber fillings with use is not considered loss of resiliency but is considered normal wear and is not a defect.

Veranda upholstery:  5-Year Limited Warranty
Fabric covers and upholstery are warranted against defective materials and workmanship for FIVE (5) years from delivery date. This five-year limited warranty does not apply to any product intentionally misused; or evidence of excessive soiling, improper cleaning, abuse, or where the fabric has had some form of chemical applied the warranty will not apply.

Any product issues should be reported promptly to the Outer Customer Service team. If a repair is warranted, Outer will make arrangements with you for the repair. Covered repairs will be completed within a reasonable timeframe. For products more than ONE (1) year old, the original retail purchaser is responsible for labor in making the repair and also for associated shipping costs incurred with a repair. Materials cost covered under the lifetime limited warranty is covered by Outer.

IMPORTANT INFORMATION
This limited warranty establishes the original retail purchaser's exclusive remedies. No representative, dealer, or employee of Outer has the authority to increase or alter the obligations or limitations under this warranty. The obligations of Outer under this warranty shall not exceed the cost of the nonconforming products). The duration of any implied warranty, including that of merchantability or fitness for any particular purpose, shall be limited to ONE (1) year from the date of purchase. IN NO EVENT SHALL OUTER BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES.

(Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation exclusion may not apply.)

Subject to the exclusions described herein, the Limited Warranty for Outer Fire Pit Tables covers major cracking (cracks measuring more than the thickness of a quarter) of the concrete surfaces and blistering or peeling of the finish, and any other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or substantially alter the appearance of the piece.

NOT COVERED:

• Spotting and/or non-structural hairline cracks measuring less than the thickness of a quarter. Scratches, dents, minor chipping and/or cosmetic blemishes as a result of normal exposure to the elements
• Staining of the concrete surface by food, drink or other substance
• Any damage due to standing or sitting on the concrete surface
• Cracking of the concrete surface resulting from moving the table or using the burner flame setting higher than the prescribed limit when the griddles are installed
• Any damage due to extreme weather or environmental conditions

Subject to the exclusions described herein, the Limited Warranty for OuterStone Fire Pit Tables covers the OuterStone material, and any other defects in workmanship and materials that cause the product to be unsound structurally or mechanically, or substantially alter the appearance of the piece.

NOT COVERED:

• Scratches, chipping, and/or cosmetic blemishes as a result of normal exposure to the elements
• Staining of the OuterStone surface by food, drink or other substance
• Any damage due to standing or sitting on the OuterStone surface
• Damage to the OuterStone surface resulting from moving the table or using the burner flame setting higher than the prescribed limit when the griddles are installed
• Any damage due to extreme weather or environmental conditions

Note: For purposes of this Limited Warranty, Fire Pit Table accessories are deemed “Other Outer Products” and are covered by the Limited Warranty for Other Outer Products described below.

Umbrellas

Outer Umbrella: Fabric Canopy

PRODUCT-SPECIFIC EXCLUSIONS, CONDITIONS, AND DETAILS (See also What is NOT Covered under this Limited Warranty?)
Subject to the exclusions described herein, the Limited Warranty for Outer Umbrella Fabric Canopy covers any rot, mildew, or colorfastness that causes the product to be unsound structurally or mechanically, or that substantially alters the appearance of the piece, typical in normal atmospheric conditions. The product must be properly installed, maintained, and under normal use and environment.

NOT COVERED:

• Damage caused by contact with foreign objects, abuse, misuse, negligence, vandalism, burns of any kind, improper cleaning techniques, normal wear, perforations, weather soiling, environmental pollution stains, stains and other damage caused by animals, including bird droppings, natural disasters, or acts of nature, including hail, lightening, wind-blown debris, or damage caused by strong winds.
• Damage caused by the storage method or location

Subject to the exclusions described herein, the Limited Warranty for Outer Umbrella Frame covers manufacturer defects to the mast (pole), the sliding hub assemblies, the rib assemblies, the cord cam-lock assembly, and the para-cord which causes any of these parts to fail in their respective normal function.

NOT COVERED:

• Damage sustained or cause by contact with foreign objects, abuse, misuse, negligence, vandalism, burns of any kind, improper cleaning techniques, normal wear, weather soiling, damage caused by animals, natural disasters, or acts of nature, including hail, lightening, wind-blown debris, or damage caused by strong winds.

Subject to the exclusions described herein, the Limited Warranty for Outer Umbrella Base covers manufacturer defects to the tubular sleeve, the metal plates, the stainless steel hardware, the tightening knobs, and the plastic adaptors which cause any of these parts to fail their respective normal function.  

GALVANIZED PLATE BASE DISCLAIMER
Galvanized steel will show unavoidable imperfections due to the zinc-finishing process and therefore must be accepted in the condition in which it is received.  It is normal for the zinc finish to include wavy patterns and slight discoloration.  Each base will appear unique. Over time, the surface may develop a patina. This is a natural process that will not affect the quality or performance of your piece, and is not considered a quality defect.

Subject to the exclusions described herein, the Limited Warranty for the Insert covers seam slippage or strength loss and other defects in workmanship and materials that substantially alter the appearance or structural integrity of the item.

Note: Post consumer recycled polyester fiber used in the OuterWeave Throw Pillow will soften and conform to the shape of the user as a result of normal use. This is not considered a manufacturing defect. Outer will only warrant the Insert against abnormal loss of fill resiliency if it determines that such loss is not caused by normal use.

• Normal flattening or compression of insert
• Throw Pillow Insert used with non-Outer covers

Subject to the exclusions described herein, the Limited Warranty for Other Outer Products covers defects in workmanship and materials that cause the piece to be unsound structurally, or substantially alter its appearance, or cause it to become unserviceable.

NOT COVERED:

• Tears, shrinkage, stretching or pilling of fabric
• Color changes due to normal exposure to sun and atmospheric chemicals
• Minor variations in color or texture of materials such as fabric or rugs
• Staining

Outer Partner Products

Napa Home products and any other products from partner brands are not covered by Outer's warranty. Outer will provide partner warranty details as made available from our partners. Partner products without a listed warranty have no warranty coverage unless otherwise stated.

What must I do to protect my Outer Products?

Outer has taken great care in designing and building its products to stand up to harsh environments, but nothing is foolproof. Care and maintenance are required to ensure the proper lifetime of your furniture and other products. While mildew and mold grow on dirt, pollen and other organic matter, simple routine cleanings can prevent them from forming on fabrics. Cover the products when not in use and store them in a dry place during the off-season. Before covering, products need to be thoroughly cleaned and dried to prevent mildew during storage. Cushions should be removed and stored in a dry place, if possible. Extra care is required if the products are used by an indoor pool or near the seaside. What is NOT Covered under this Limited Warranty?

This Limited Warranty does not cover any damage due to:

• Transportation
• Improper Storage
• Improper or negligent use, handling, assembly, or care of Covered Product, including, without limitation, the use of improper cleaning products, sun-tan oils or other chemicals
• Failure to follow the Covered Product instructions or to perform any preventive maintenance
• Modifications (excluding Fire Pit conversion to NG or LPG using an Outer Conversion Kit)
• Fire Pit conversion to NG or LPG using an aftermarket Conversion Kit
• Unauthorized repair
• Normal wear and tear, corrosion, rust or stains, scratches, or dents, including the rusting or tarnishing of metal materials resulting from abrasive scratches
• Non-residential uses
• Excessive weight placed on the Covered Product, including damage to the frame or legs of Covered Products
• Mold or mildew
• Bursting or cracking of tubing due to exposure to water and freezing temperatures
• Accident, abuse, neglect, theft, vandalism, pets, rodents, fire, flood, wind, hail, lightning, freezing temperatures, extreme temperatures, natural disasters or acts of God of any kind, or other external causes beyond Outer’s reasonable control
• Some natural teak oil may transfer to fabric, cushions or OuterShell® covers during every day usage. This is a normal behavior for teak; oil transfer to cushions and OuterShell® will not be covered by Outer's warranty

What are my Remedies under this Limited Warranty?

If we receive a valid claim for a Defective Product within the applicable Warranty Period, we will either (a) repair the Defective Product at no charge, using new or refurbished replacement parts, or (b) exchange the Defective Product with a new or refurbished Product. If we, determine it is not reasonable to repair or replace the Defective Product, we may choose to refund to you the purchase price paid for the Defective Product, rather than repair or exchange it.

You may be responsible for payment of shipping and handling charges for the delivery of a repaired or replacement product.

Any replacement product will be warranted for the remainder of the original Warranty Period or thirty (30) calendar days, whichever is longer.

How do I obtain Warranty Service?

To obtain a repair, replacement or refund for a Defective Product under this Limited Warranty (“Warranty Service”), you must call (855) 277-7744 or email our Customer Service Department at orders@liveouter.com during the applicable Warranty Period. You will need to provide photos and a description of the defect.

Disclaimers; Implied Warranties.

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. OUTER DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, OUTER LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY AND, AT OUTER’S OPTION, THE REFUND AND REPLACEMENT REMEDIES DESCRIBED ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Limitation of Liability.

**EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, OUTER SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF OUTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY NOR, UNDER ANY CIRCUMSTANCES, SHALL OUTER’S LIABILITY UNDER THIS LIMITED WARRANTY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. **

Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Governing Law; Severability.

This Limited Warranty will be governed by the laws of the State of California, USA, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction. If any term of this Limited Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms will not be affected or impaired.
